Father declaration & shared custody agreement Services

This service is only relevant for opposite-sex parents who are not married at the time of birth. In this case, the birthing mother:

- is the sole parent to the child - unless a father declaration (Vaterschaftsanerkennung) was made

- and enjoys 100% of custody rights - unless a custody agreement (Sorgerechtserklärung) was put in place 

 

For opposite sex parents who are married at the time of birth: the baby will automatically have two parents (the birthing mother and her spouse) who will share custody rights 50/50.

 

For same sex parents, regardless of whether they are married or not at the time of birth: the birthing mother will be the sole parent of the child and enjoy 100% of custody rights, until the other parent(s) adopt(s) the baby. Only then can the custody rights be shared with them.

 

Father declaration:

In German this is called a Vaterschaftsanerkennung. This means the dad declares being the father of the (unborn) child and the mother agrees. The father will be stated as a parent on the birth certificate of the child. The father declaration also gives the dad permission to see his child (Umgangsrecht) where and when permitted by the mother, however all decisions and responsibilities lie with the mother if no shared custody agreement is done.

 

Shared custody agreement:

In German this is called Sorgerechtserklärung. It is a procedure whereby the mother decides to shared her custody right 50/50 with the father. The father then has to be consulted for all important decisions regarding the child (place of residence, school attendance etc).

  

When to apply:

Both procedures can be done before or after the birth, although it is advisable where possible to get it done before the baby is born so that the father can be declared as a parent on the baby's birth certificate, carry his name if desired etc.

  • Professional, discreet and precise translation work on the day of the procedure. Please note that Standesamt and Jugendamt will request that you bring a translator with you if they consider that one or both parents do not speak enough German.


What is the process?

  1. Book here the package you are interested in
  2. Select a date and time for the consultation
  3. During the consultation, we will discuss your individual situation. Then I will proceed with contacting the relevant local authorities and ensure you get the procedure on track. For the Premium package: on the day of the appointment, we will meet directly there and I will translate. The appointment usually lasts about one hour onsite.
